1. Introduction
These Terms and Conditions of Sale (“Terms”) govern all purchases made through our website. By placing an order, you agree to these Terms in full.
The Website is operated by Nicolas AQO, registered in France. All artworks sold are original creations by Nicolas AQO, printed and shipped on demand.
2. Products
We offer high-quality art prints featuring original digital creations. Our artistic process is hybrid and includes the use of digital tools, professional editing software, and generative artificial intelligence under the artist's creative direction. Products include posters, canvases, and other formats as displayed on the Website.
All items are made to order. Slight variations in color, cropping, or dimensions may occur due to the printing process.
Product information, availability, and prices are subject to change without notice, though we strive to ensure all content is accurate and up to date.
3. Ordering and Payment
Orders are placed exclusively via the Website. Once your order is confirmed, production begins immediately.
Accepted payment methods include credit cards, PayPal, and other secure options provided at checkout.
All prices are displayed in the selected currency and include applicable taxes unless stated otherwise. Currency conversions are for informational purposes only, and final charges are made in the currency selected at checkout.
4. Shipping and Delivery
Products are made and shipped after each order is placed. Delivery times vary based on destination and shipping method. Estimated delivery times are shown at checkout for reference only and are not contractually binding.
We are not responsible for delays caused by customs, postal services, or other third parties. Additional import duties or taxes may apply depending on your location and are the buyer’s responsibility.
5. Right of Withdrawal (EU Customers)
As per European law, customers in the EU have a 14-day withdrawal right from the date of delivery.
⚠️ Exception: This right does not apply to customized products made to order, as permitted under Article L221-28 of the French Consumer Code.
If your item is defective or incorrect, you are still entitled to a replacement or refund (see section 6).
6. Returns and Refunds
Each product is made to order, which means we do not accept returns or exchanges due to buyer’s remorse (e.g. ordering the wrong size, changing your mind, or disliking the product after receiving it).
A return or refund is only possible if:
- The product arrives physically damaged (e.g. torn, stained, broken)
- The product received is substantially different from what was ordered (e.g. wrong size, wrong design, or a printing error)
Please note:
- Slight color variations due to monitor settings or the printing process are not considered defects
- Minor variations in image placement or cropping may occur due to full-bleed printing and are part of the standard production process
These differences do not qualify for a return, refund, or replacement.
How to Request a Return
If your item meets the above conditions, contact us at nicolasaqo.contact@gmail.com within 7 days of delivery.
Include your order number and clear photos showing the issue.
If your request is approved, we will issue a replacement or refund.
7. Intellectual Property
All illustrations, designs, and content on this Website are the exclusive intellectual property of Nicolas AQO.
By purchasing a product, you receive a physical item only. You do not acquire rights to reproduce, distribute, or resell the artwork.
Any unauthorized use is strictly prohibited and may result in legal action.
8. Limitation of Liability
We shall not be held liable for:
- Delivery delays due to postal or customs issues
- Damage caused by third-party carriers
- Indirect or consequential losses
Our liability is strictly limited to the amount paid for the product in question.
9. Privacy and Data Protection
We respect your privacy. Your personal data is handled in accordance with our Privacy Policy, and we comply fully with the EU General Data Protection Regulation (GDPR).
We never sell or share your data with unauthorized third parties.
10. Governing Law and Jurisdiction
These Terms are governed by French law. In the event of a dispute, the competent courts shall be those of Aix-en-Provence, France.
